These Terms of Use and Sale apply to the website and purchases offered by Ardelius, Inc. d/b/a MorFurn (“MorFurn,” “we,” “us,” or “our”). By using this website or submitting an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the website or submit an order.

Eligibility and acceptable use

You must be legally capable of entering a binding agreement. You may use the website only for lawful personal or business purchasing purposes. You may not interfere with the website, misuse another person’s information, attempt unauthorized access, introduce malicious code, scrape the website in a manner that disrupts service, or use the website for fraud or unlawful activity.

Product information

We work to present accurate product descriptions, dimensions, colors, images, prices, and availability. Manufacturer-supplied information and inventory may change. Screen settings and photography can affect color appearance. Measurements are approximate unless expressly stated otherwise. Please contact us before ordering if a specific feature, finish, dimension, configuration, or delivery requirement is material to your purchase.

Prices, taxes, and errors

Prices are stated in U.S. dollars unless otherwise indicated. Applicable taxes, delivery charges, deposits, assembly charges, and other accepted charges are shown at checkout or confirmed before an order is finalized. We may correct typographical, pricing, availability, or catalog errors before accepting an order. If a correction materially affects an order, we will request your approval or allow cancellation of the affected unfulfilled item.

Order submission and acceptance

An order confirmation acknowledges receipt of your request and does not by itself constitute acceptance. Orders remain subject to product availability, payment authorization, fraud review, delivery eligibility, and MorFurn’s acceptance. We may contact you to verify identity, payment, address, access, or delivery details. We may decline or cancel an order when reasonably necessary because of unavailability, pricing error, suspected fraud, legal restriction, or inability to fulfill the order. If we cancel after collecting payment, we will issue the appropriate refund.

Payments and deposits

MorFurn accepts only the payment methods displayed at checkout or confirmed in writing for the order. You authorize MorFurn and its payment service providers to obtain payment authorization and process the amounts you approve. Cash on Delivery is available only for eligible orders and areas and may require identity, address, or order verification. Some orders may require a deposit or advance payment disclosed before acceptance. See our Payment Methods Policy and Cash on Delivery information.

Third-party payment, financing, and lease-to-own services

Any digital wallet, buy now pay later, financing, or lease-to-own option is offered and administered by an independent provider. Provider approval, availability, spending limits, initial payments, fees, interest, annual percentage rates, ownership terms, state eligibility, privacy notice, and customer agreement are determined by that provider. MorFurn is a retailer and is not a bank, lender, card issuer, or lease-to-own provider. See our Payment & Financing Information.

Shipping, delivery, inspection, and delays

Shipping and delivery are governed by our Shipping and Delivery Policy. Delivery estimates are not guarantees. Please inspect merchandise at delivery and report visible damage to the delivery team when possible. Concealed damage, missing parts, defects, or incorrect merchandise must be reported promptly as described in our Returns and Refunds Policy. Nothing in these Terms limits rights that cannot be waived under applicable law.

Cancellations, returns, refunds, and warranties

Order cancellations, return eligibility, fees, damage claims, and refunds are governed by our Returns and Refunds Policy. Manufacturer warranties vary by item; see our Product Warranty Information. A third-party payment or lease provider may control how an approved refund affects the customer’s provider account or payment schedule.

Accounts and communications

You are responsible for maintaining the confidentiality of your account credentials and for providing accurate contact information. Transactional communications may be sent as needed to service an order. Marketing email or SMS is sent only in accordance with the consent choices presented to you. You may unsubscribe from marketing email through the message and from marketing texts as described in our SMS Terms.

Website content and third-party services

The website and its original content are owned by or licensed to MorFurn and may not be copied or commercially exploited without permission. Manufacturer names, product information, and trademarks belong to their respective owners. Links, payment services, applications, and other third-party features are governed by the applicable third party’s terms and privacy notice.

Disclaimers and limitation of liability

The website is provided on an “as available” basis. To the maximum extent permitted by law, MorFurn disclaims implied warranties relating solely to website availability and does not promise uninterrupted or error-free access. Product warranties, statutory warranties, refund obligations, and other rights that cannot lawfully be excluded remain unaffected.

To the maximum extent permitted by law, MorFurn is not liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of or inability to use the website. This limitation does not exclude liability that cannot be limited by law and does not alter MorFurn’s express obligations concerning accepted orders, refunds, delivery damage, or product warranties.

Privacy and accessibility

Our collection and use of personal information are described in our Privacy Policy, Notice at Collection, and Cookie Notice. Accessibility assistance is available as described in our Accessibility Statement.

Changes and severability

We may update these Terms prospectively by posting a revised effective date. The terms presented when an order is accepted govern that order unless the parties agree otherwise or applicable law requires a different result. If any provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law.

Governing law

These Terms are governed by applicable United States federal law and Texas law, without limiting any mandatory consumer protection that applies based on the customer’s location.
